Editor's Note
This Autumn 2007 edition of TELS ENews deals with two
issues arising out of WorkChoices, which has just celebrated
its first full year of operation. Both issues have been
the source of constant enquires from clients over the
last few months.
Issue one is the place of Alternative Dispute Resolution
(or ADR) in the resolution of disputes under WorkChoices.
The Employment Law Specialists is a firm believer in
the benefits of using ADR in the workplace setting and
continues to see successful outcomes from this form of
dispute resolution. This article sets out the context
of ADR in resolving disputes in workplaces covered by
WorkChoices and provides guidance on the legislative
requirements facing both employers and employees.
The second article deals with the possible impact of
WorkChoices on the NSW Workplace Surveillance Act 2005.
In the absence of any testing of its continued coverage
of WorkChoice governed employers in NSW, we show employers
some of the key ways to ensure compliance with the far-reaching
implications of this Act.

WorkChoices & Alternative Disputes
Resolution processes – what you need to know.
WorkChoices has radically changed the work environment
in so many ways. One of the lesser known impacts of
WorkChoices legislation is on the way disputes are
now required to be resolved. Employers and employees
are now compelled to deal with mandated provisions
in WorkChoices specifying Alternative Dispute Resolution
(ADR) processes.

Workplace Surveillance in NSW - are you
covered?
While the NSW Workplace Surveillance Act 2005 became
a legislative obligation in all NSW workplaces from
7 October, 2005, it has not been tested to date to
see if its provisions have been displaced by WorkChoices.
